1. About these terms

These terms govern your use of www.precisionmedicineinternational.com and the XY Leap™ Omics Platform, provided by Precision Medicine International Limited ("PMIL", "we", "us"), a New Zealand company (company number 3786616) based in Christchurch.

By using our website or platform, you agree to these terms. If you access XY Leap through a healthcare provider, distributor or other partner, your agreement with them may add further terms. If they conflict with these terms, the partner agreement applies for that service.

2. Our website

Our website gives general information about PMIL and our products. It is not medical advice, and you should not rely on it to make decisions about your health or treatment.

3. The XY Leap platform

XY Leap is clinical decision support software, registered with Medsafe, New Zealand's medicines and medical devices regulator. It analyzes genetic data to produce reports on medicines, nutrition, exercise, sleep and environmental exposures.

  • It supports clinical judgment and does not replace it. Reports are for use by, or with, a qualified healthcare professional. Do not start, stop or change a medicine based on a report without speaking to your clinician.

  • Reports reflect the evidence available when they are produced. Science changes, and a report may be updated as new evidence is published.

  • Accuracy depends on the data we receive. We rely on the genetic data from an accredited laboratory and the information your provider supplies.

  • Availability varies by country. Intended use and access depend on local regulatory approval.

4. Not for emergencies

XY Leap and our website are not an emergency service. If you have a medical emergency, contact your local emergency number or go to the nearest emergency department.

5. Accounts and access

If you have an account, keep your login details secure and tell us promptly if you think someone else has used them. You are responsible for activity under your account. Clinicians must hold a current registration to practice and use XY Leap only within their scope of practice.

6. Fees and subscriptions

One analysis gives lifetime access to the platform. An optional subscription keeps reports and insights current. We provide XY Leap to healthcare providers, distributors and other business partners, not directly to consumers. Prices, payment terms and cancellation terms are set out in our agreement with them. If you access XY Leap through one of them, any fees you pay are set by them.

7. Acceptable use

You must not:

  • use the website or platform unlawfully, or to harm anyone;

  • copy, resell, reverse-engineer or scrape the platform, its reports or its data;

  • try to re-identify anyone from coded or de-identified data;

  • interfere with the security or operation of our systems; or

  • upload information you do not have the right to share.

8. Intellectual property

PMIL owns or licenses the website, the XY Leap platform, the XY Analytics™ engine, reports, content and trademarks. You may use reports for your own care or, for clinicians, for the care of your patients. You may not use our names or marks without our written permission.

9. Privacy

Our Privacy Policy explains how we handle personal and health information, including under the Health Information Privacy Code 2020.

10. Third-party sites

Our website may link to other sites. We are not responsible for their content or privacy practices.

11. Our responsibility to you

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other law that cannot be excluded.

  • Business users. If you use our services for business purposes, the Consumer Guarantees Act 1993 does not apply, to the extent the law allows.

  • Limit of liability. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees paid to us under the relevant agreement in the 12 months before the claim.

  • Clinical decisions. Treatment decisions remain the responsibility of the treating clinician.

12. Changes and suspension

We may update these terms, the website or the platform. The current terms are always on our website, with their date at the top. We will tell platform users about significant changes before they take effect. We may suspend access if these terms are breached or to protect the security of our systems.

13. Governing law

These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction. If you use XY Leap in another country, local consumer law may also apply.
